I think I get it at last! The Creative Commons license does not replace one’s copyright – it merely modifies the copyright and gives the person who buys the album some additional rights.

Let us for example look at the license I will use for my next album and the New ListeningLounge, coming to our web site in late Summer of 2005 or whenever Canton is done with it – see above title-link:

This license consists of three parts.
The first is Attribution. You must give the original author credit.
The second is Noncommercial. You may not use this work for commercial purposes.
The third is Share Alike. If you alter, transform, or build upon this work, you may distribute the resulting work only under a license identical to this one.

What does that mean, you ask? It simply states that you may use the music for non-commercial purposes. If, for example, you make video about yourself running naked through Albuquerque, you may use my music as long as you do not derrive any money from said movie and you allow other people to do share alike. As soon as you sell DVDs, you have to obtain a license from me for the use of my music. You may also make a copy of my music, but you may not sell that copy.

    Damn! And I was going to make a bundle on my copyright infringing “Naked in Albuquerque” movie.

    Creative Commons seems like the only way to go. Do you see any negative to it?

    No, Matt, I don’t think there is a real downside. We all have some shared music in our collections. We all have copied a friend’s CD or made a compilation CD for the car, or gave a compilation CD to a friend. We also have used music for a home movie, a slide-show for friends, etc… So all I am doing with the CC license is de-criminalyzing what we all do anyway.
